Probation

In most cases, with a DUI you will be placed on 3 years probation. If you don’t get or accept probation you will have to actually serve some jail time. In a 2nd,3rd, or 4th DUI you may get jail in “addition” to probation. If your DUI is a misdemeanor(most are) you will be on probation to the Court, otherwise known as informal or summary probation. You will not have to report periodically and be supervised by a probation officer. If you plead to a felony DUI you will be placed on formal probation where you actually report and are supervised by a probation officer.

With either a misdemeanor or a felony DUI, as a condition of probation, you may be required to perform community service, attend certain programs, pay fines and penalties, comply with alcohol conditions, attend an alcohol or drug treatment program, and remain law abiding. If you fail to meet your conditions or if you pick up another DUI charge or other criminal violation while you are on probation, you could face a probation revocation hearing which could include the penalty of jail time.
