DMV Hearings in San Diego

A person charged with a DUI must notify and request a hearing with the DMV within 10 days of their arrest date. You may have to put your request in writing by fax or letter. Calling the DMV within 10 days will give you the opportunity to receive a hearing date. It may be better or also necessary to request the hearing date in writing and deliver the request to the DMV by fax or mail. Your lawyer can advise you about this process. Your lawyer may be able to get you a restricted license for school, work, or other hardship. If the DMV conducts a hearing and suspends your license it will be for 4 months for a first time DUI. Again, having a good lawyer handle your case is to your great benefit. You may be able to win the hearing and keep your license. Please remember, this is a separate part of the DUI process. It has nothing to do with the San Diego Court system and your obligation to attend your hearing on your assigned court case date.
