MANSLAUGHTER

California Penal Code § 192. Manslaughter.

Manslaughter is the unlawful killing of a person without malice. There are three kinds of manslaughter:

(a) Voluntary – happens during a sudden fight or in the heat of passion.

(b) Involuntary – the commission of an illegal act (not a felony); or committing a legal act which could produce an illegal death with recklessness. This subdivision does not apply to acts committed while driving a vehicle.

(c) Vehicular –

(1) Driving a vehicle in the commission of an illegal act (not a felony) with gross negligence; or driving a vehicle in the commission of a legal act which could produce an illegal death, but with gross negligence.

(2) Driving a vehicle while under the influence of drugs or alcohol and a) committing an unlawful act (not a felony) without gross negligence; or b) committing a lawful act which could produce an illegal death without gross negligence.

(3) Driving a vehicle where the collision was knowingly caused for financial gain and directly resulted in the death of another person.
