ADMINISTRATION OF CHEMICAL TESTS

§ 23158. Administration of Tests.

(a) Only specific, licensed professionals may withdraw your blood for the purpose of determining its alcohol content. This limitation does not apply to breath tests.

(b) You can, at your own expense, have someone else conduct a chemical test for the purpose of refuting the test done by law enforcement.

(c) You or your attorney have the right to obtain the results from the law enforcement chemical test.

(d) You can’t sue the people or property where law enforcement has your blood drawn if they follow proper blood draw procedures.

(i) If you choose to take a urine test, the test will be administered in such a way that both security and your privacy can be managed.

Do Not Rely on This Statutory Interpretation. It is for Guidance Only! Make sure you consult the actual California Vehicle Code for the most accurate and current statement of the law.
