Blood Alcohol Level

Your blood alcohol level can have an effect on your case in a number of different ways. In your sentencing you may have a harsher sentence depending on the amount of alcohol in your blood at the time of driving. In certain courts, for instance, you can expect to get 5 days public work service up to a .14BAC. A .15 to a .19 will get you 10 days and a .20 to a .24 will get you 20 days.

If you have a second DUI the consequences for a higher BAC will be event more pronounced. Different judges in different courts have different standards.

Another arena in which your blood alcohol level will matter is in treatment program requirements. In a first DUI, as a condition of being placed on probation, you must complete an alcohol/drug treatment program. If your blood alcohol level was less than a .20 you will be required to complete a 3 month program. If your blood alcohol level was .20 or more you will required to complete a 6 month program.

In addition you blood alcohol level will have an effect on plea bargaining, sentencing, and the systems general view of the seriousness of the case. The higher the BAC the more serious the system will view your situation.
